Police, SWAT surround home after man shoots at neighbor in Dayton

Patrol officers later spot suspect, take him and a relative into custody

Police and a SWAT team surrounded a home Tuesday night in Dayton after a report of a man firing a weapon at his neighbor.

Police responded shortly before 9 p.m. to the 1100 block of Demphle Avenue.

“Officers heard a succession of gunshots and believed the suspect had retreated back inside of his residence,” said Dayton police Lt. Jason Hall in a statement released Wednesday afternoon.

“The initial investigation reveals that this violence likely stemmed from an ongoing dispute between the suspect and his neighbors,” Hall said.

Officers asked neighbors to shelter in their homes and in some cases to evacuate homes.

After repeated attempts to make contact with the suspect, who was not named, the special weapons and tactics team and hostage negotiation team were called to the scene.

On social media, Dayton police said that parts of Demphle Avenue and Nassau Street were closed due to the police presence there.

Later, police discovered the suspect was not inside the residence.

Patrol officers found the suspect around 10:30 a.m. Wednesday in the 1000 block of West Third Street and took him into custody, Hall said. The man’s relative also was taken into custody on charges not directly related to the Demphle Avenue situation, Hall said.

Although police did not identify either man, Damon Bryce Smith, 46, who lives at the Demphle Avenue home at center of the Wednesday night police response, was arrested around 10:30 a.m. in the 1100 block of West Third Street. He was booked into the Montgomery County Jail on a preliminary charge of felonious assault and also was booked on three misdemeanor charges in a separate case.

Brice Jerome Smith, 20, also was arrested at that time in the 1000 block of West Third Street. He was booked into the Montgomery County Jail on suspicion of failure to comply with an order or signal of a police officer, jail records show.

The incident remains under investigation and the case will be presented to the Montgomery County Prosecutor’s Office for consideration of charges, Hall said.
